BOUNCE DAILY – Online Rider Agreement

1. Agreement and Acceptance

This electronic Rider Agreement ("Agreement") is entered into between Wickedride Adventure Services Private Limited ("Company", "we", "our", or "us") and you, the individual ("Rider", "you", or "your") accessing and using the Bounce Daily platform to rent electric vehicles. By clicking Accept or using our services, you legally agree to these terms, which constitute a binding contract under the Indian Contract Act, 1872.

2. Definitions

• Platform: The Bounce Daily mobile application, website, APIs, and any technology used to deliver services.
• Vehicle: An electric scooter and battery owned or managed by the Company.
• Security Deposit: A refundable sum held against damages or dues.
• Service Area: Zones designated by the Company where vehicles can be lawfully operated or returned.
• Applicable Laws: All Indian laws, rules, regulations, traffic laws, and municipal codes in effect.

3. Eligibility & User Verification

You represent and warrant that:

• You are at least 18 years old.
• You possess a valid Indian driver’s license for two‑wheelers (non‑gear).
• You have submitted authentic, current, and complete KYC documents as required.
• You authorize us to verify your identity via Aadhaar, driving license, or other mechanisms.
• Fraudulent submissions or impersonation will lead to immediate termination and legal prosecution.

4. Scope of Service

You are granted a limited, revocable, non‑transferable license to use the Vehicle for personal, lawful, short‑term transportation within operational areas. You may NOT:

• Sublet, lend, lease, or share the Vehicle.
• Use the Vehicle for commercial deliveries unless authorized.
• Ride under the influence of alcohol, drugs, or intoxicants.
• Disassemble, hack, reverse‑engineer, damage, or tamper with the Vehicle.
• Leave the Vehicle outside the Service Area or unreturned.

5. Rider Obligations

• Conduct a pre‑ride inspection and report damages before use.
• Use a helmet at all times, as per the Motor Vehicles Act, 1988.
• Follow all traffic and civic rules, including parking regulations.
• Safely return the Vehicle in working condition before the rental period expires.

6. Rental Fees, Deposits, and Billing

• Rentals are prepaid weekly via the Platform.
• A Security Deposit or Advance Rental is mandatory and may be deducted for:
  • Damages beyond fair use,
  • Traffic violations or penalties,
  • Towing/retrieval if abandoned,
  • Breach of terms.
• Outstanding charges may be auto‑debited from linked payment methods or pursued through legal action.

7. Penalties & Offenses

The Company reserves the right to recover all dues via payment methods, wallet balances, or legal means.

8. Limitation of Liability

• The Company does not guarantee safety, uninterrupted availability, or immunity from accidents, theft, or malfunction.
• The Rider is solely responsible for personal safety, third‑party claims, property damage, and injuries.
• The Company disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

9. Indemnity & Release

You agree to fully indemnify, defend, and hold harmless the Company, its affiliates, directors, employees, and agents against any and all claims, losses, liabilities, costs, penalties, proceedings, and expenses arising from:

• Your use or misuse of the Vehicle or Platform,
• Breach of this Agreement or violation of any law,
• Injury or damage to third parties, including passengers or pedestrians,
• Non‑payment or fraud.

This clause survives termination of the Agreement.

10. Insurance & Accidents

• The Rider must immediately report accidents, police FIRs, third‑party injuries, or damage.
• Non‑reporting or concealment may lead to legal consequences and voiding of coverage.

11. Termination

By the Company (Immediate)

• Breach of any terms or violation of law,
• Fraud, theft, impersonation, or tampering,
• Non‑payment or failure to return Vehicle.

By Rider

• You may deactivate your account with 15‑day notice via the Platform.

Upon Termination

• All dues become payable immediately.
• All Company property must be returned within 24 hours.
• Company may initiate civil/criminal legal proceedings.

12. Intellectual Property

All content, branding, logos, system design, and platform elements are the sole property of the Company. Unauthorized use, copying, or commercial exploitation will result in legal action under applicable laws.

13. Privacy & Data Use

You consent to collection and usage of personal data including GPS location, ride logs, payment history, and ID proofs. Data may be shared with law enforcement or regulatory bodies, and partners for fraud control or operational support. Data will be stored securely and used in compliance with the Information Technology Act, 2000 and associated rules.

14. Governing Law & Dispute Resolution

• This Agreement is governed by the laws of India.
• Any disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996.
• Seat: Bengaluru, Karnataka  |  Language: English
• The award shall be final and binding.
• Courts in Bengaluru have exclusive jurisdiction for interim relief or enforcement.

Digital Consent & Execution

By clicking Accept, you confirm that you are legally competent and authorized to enter into this Agreement, have read and understood these terms, and agree to be bound by them. This Agreement is executed digitally in compliance with the Information Technology Act, 2000 and is legally binding.
